RESOLUTION 2012 -150R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING AN AGREEMENT BETWEEN THE CITY AND <br />RECREATION & PLANNING, INC. FOR THE PROVISION OF <br />PROFESSIONAL ENGINEERING SERVICES IN CONNECTION WITH THE <br />BANK STABILIZATION AND PERMANENT ACCESS POINTS PROJECT IN <br />AN AMOUNT NOT TO EXCEED $172,000.00 CONTINGENT UPON THE <br />ENGINEER'S PROVISION OF SUFFICIENT INSURANCE IN ACCORDANCE <br />WITH THE ATTACHED AGREEMENT AND THE EDWARDS AQUIFER <br />AUTHORITY'S APPROVAL OF AN INTERLOCAL AGREEMENT WITH THE <br />CITY FOR AQUIFER HABITAT CONSERVATION PLAN PROGRAM <br />FUNDING; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached agreement between the City and Recreation & Planning, Inc. <br />for the provision of professional engineering services in connection with the Bank Stabilization <br />and Permanent Access Points Project in an amount not to exceed $172,000.00 is approved <br />contingent upon the Engineer's provision of sufficient insurance in accordance with the attached <br />agreement and the Edward's Aquifer Authority's approval of an interlocal agreement with the <br />City for Aquifer Habitat Conservation Plan Funding. <br />PART 2. The City Manager is authorized to execute the Agreement on behalf of the <br />City. <br />PART 3.
