COMBS <br />ADDITION; APPROVING THE SALE OFTHIS RIGHT-OF-WAY TO TUTTLE <br />LUMBER COMPANY; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />A DEED; AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. On May 9, 1995, the City Planning and Zoning Commission conducted a public <br />hearing on the proposed abandonment of a 0.15 acre tract of undeveloped right-of-way of <br />Fredericksburg Street south of its intersection with Valley Street, and voted unanimously <br />to approve the proposal. <br /> <br />2. On June 12, 1995, the City Council approved the solicitation of bids for the sale <br />of this tract of right-of-way. <br /> <br />3. The City has complied with the requirements of Section 272.001 of the Texas <br />Local Government Code regarding the sale of property by a municipality. <br />~ <br /> <br /> <br />4. On July 15,1995, the City received a high bid of$1,110.78 for the sale of the <br />property described above from Tuttle Lumber Company. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the abandonment of the 0.15 acre tract of undeveloped right-of- , <br />way of Fredericksburg Street described by metes and bounds on the Exhibit A attached <br />to this ordinance is approved. <br /> <br />SECTION 2. That the sale of the parcel of the right-of-way described above for <br />$1,110.78 to Tuttle Lumber Company is approved, <br /> <br />SECTION 3. That the City Manager, Larry D. Gilley, is authorized to execute a <br />quitclaim deed conveying to Tuttle Lumber Company the right-of-way described above <br />subject to the reservation of a drainage and public utility easement covering the entire <br />property. <br /> <br />SECTION 4. That the importance of this Ordinance creates an emergency and an <br />imperative public necessity so that the provisions of the Charter requiring that ordinances <br />shall be presented at three separate meetings and that no ordinance shall become <br />effective until the expiration of ten (10) days following the date of its final passage be <br />suspended, and these provisions are hereby suspended, and this Ordinance shall take <br />effect and be in full force and effect from and after its adoption and after its publication in <br />a newspaper of general circulation within the City as provided by the City Charter of the <br />City of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 14 day of Augusi; 1995, <br /> <br /> <br />l~J~,~ <br />Mayor <br />/!\ttest: Approved: <br />v?t fJ/Y'~eJ( %p~ ~~v ~ . ~ ~ <br /> <br />J¿nis K.
