True, correct, and legible copies of any and all instruments referred to in <br /> the Title Binder as constituting exceptions or restrictions upon the title of <br /> Seller. <br /> 3.02. Purchaser shall have 10 days after the receipt of the Title Binder to review <br /> same and to deliver to Seller in writing Purchaser's objections to anything contained <br /> therein. Any item to which Purchaser does not object shall be deemed to be accepted by <br /> Purchaser. If there are objections by Purchaser, Seller shall in good faith attempt to satisfy <br /> same prior to closing, but Seller shall not be required to incur any cost to do so. If Seller <br /> is unable to satisfy the objections prior to the closing date, Purchaser may either waive the <br /> objections and accept the title Seller is able to convey, or terminate this contract by written <br /> notice to Seller. <br /> ~ <br /> 3.03. This contract is contingent on the obtaining by Purchaser of a report within <br /> 30 days after the date of this contract from a qualified firm based on a preliminary <br /> environmental site assessment regarding the presence of site conditions requiring <br /> environmental remediation under applicable federal, state or local laws. Purchaser shall <br /> pay the cost of this report. Should the report identify required remediation, Seller may <br /> choose to fully perform such remediation at its sole expense prior to closing, or Seller may <br /> refuse to do so, in which case Purchaser may cancel this contract. If Seller chooses to <br /> perform the remediation, Seller shall provide, at Seller's expense, a report to ,Purchaser <br /> prior to the Closing Date from a qualified firm verifying the results of the remediation. <br /> 4. Closing <br /> <br /> 4.01. The closing will be held on or before September 30, 1995 at the office of Hays <br /> County Abstract Company in San Marcos, Texas. <br />
