'::: 1,)<)- ~; MARCOS, TEXAS, AMENDING SECTION 31-3 OF THE SAN <br />,,;;:. ~ \i ~ ~ MARCOS CODE OF ORDINANCES TO ALLOW AN ADDITIONAL <br />it,. :3 ~' f;::. ~ MEMBER OF THE AIRPORT COMMISSION TO RESIDE OUTSIDE <br /><. ::::;;,-':; THE CITY; INCLUDING PROCEDURAL PROVISIONS, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the first two sentences of Section 31-3 of the San Marcos Code <br />of Ordinances are amended to read as follows during the period from the effective date of <br />this ordinance until January 31, 1997: <br /> <br />The airport commission consists of seven members. Three members of the <br />commission may be either residents or nonresidents of the city, and all other <br />members of the commission will be residents of the city. <br /> <br />SECTION 2. That the first two sentences of Section 31-3 of the San Marcos Code <br />of Ordinances are amended to read as follows, effective February 1, 1997: <br />. <br /> <br /> <br />The airport commission consists of seven members. Two members of the <br />commission may be either residents or nonresidents of the city, and all other <br />members of the commission will be residents of the city. <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br />invalid portion had not been adopted. <br /> <br />SECTION 4. That all ordinances and resolutions or parts of ordinances or <br />resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 5. That any person violating any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 6. That this Ordinance shall be in effect ten (10) days from and after its <br />passage, and it shall be published in a newspaper of general circulation in the area as <br />required by the Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading August 28, 1995. <br /> <br />PASSED AND APPROVED on second reading September 5, 1995. <br /> <br />PASSED, APPROVED AND ADOPTED September ll, 1995. <br /> <br /> <br /> <br />Robert T.
