<br /> , 1368 <br /> .., <br /> -.J- <br /> the annual budget of the organization to be derived from City funds, PHS declares that at the time <br /> of the execution of this agreement, funds to be provided herein do not exceed 50% of the annual <br /> budget of PHS. In the event that such funds do exceed 50% ofthe annual budget of PHS at any time <br /> during which this contract is in effect, PHS agrees to notify City immediately so that appropriate <br /> monetary adjustments to this contract can be made to assure compliance with State Law, <br /> SECTION 10. Breach of Contract: <br /> A. If the City Manager ofthe City detennines that the activities as described in the Human <br /> Services funding application attached hereto are not being carried out as approved by the City or that <br /> PHS is in breach of any of the tenns of this agreement, the City Manager shal} notify PHS in writing <br /> of the deficiency. PHS shall have ten (10) working days from the date of the notice to correct or <br /> satisfy the deficiency. <br /> B. If the deficiency is not appropriately corrected or satisfied in the opinion of the City <br /> Manager "within the prescribed time, notice may be given to PHS that its funding will be terminated. <br /> C. A decision of the City Manager to termìnate funding may be appealed to the City's <br /> Human Services Advisory Board within ten days of the date of the notice to terminate funding, <br /> During the appeal process, funding to PHS shall continue, <br /> D, The Human Services Advisory Board shall conduct a hearing on the matter within ten <br /> (10) days of receipt of an appeal and render a decision on the appeal as soon as practicable thereafter. <br /> E, An appeal from a decision by the Human Services Advisory Board may be taken by either <br /> party to the City Council, in vvTiting, within ten (10) days of the decision of the Human Services <br /> Advisory Board.
