<br /> 1,3£ <br /> Page 6 <br /> Agreement will be awarded to any taxing unit as that phrase is defined in Section 1.04 of <br /> the Texas Tax Code. <br /> B. The Board shall develop guidelines regarding the process for allocation of these <br /> funds to specific persons, organizations and events. A copy of the guide,lines shall be <br /> -- provided to the City, and to any person applying for an allocation of arts funding. <br /> i <br /> ! <br /> 5. <br /> TERM; TERMINATION <br /> A. The term of this Agreement shall be from October 1, 1995 through September <br /> 30, 1996. It is expressly agreed that either party may cancel this Agreement by tendering <br /> written notice to the other. Upon expiration of thirty (30) days from the date of the written <br /> notice or any date specified after thirty (30) days from the date of the notice, this <br /> . <br /> Agreement shall be terminated. <br /> B. Any funds allocated to the Chamber by the City which are unencumbered or <br /> unexpended on the effective date of the termination of this Agreement shall be remitted to <br /> City on or before the expiration of thirty (30) days from the date of the termination. <br /> , <br /> , 6. <br /> CONSTRUCTION <br /> This Agreement shall be construed in accordance with the laws of the State of <br /> Texas, and in particular Chapter 351 of the Texas Tax Code. <br /> 7. <br /> The Chamber shall keep its equipment, supplies, vehicles and other assets separate <br /> from those purchased with hotel occupancy tax funds and to be used in the performance <br />
