Q =8 <br />~ . 5.~ <br />ill ;:; - id-= <br />'oJ "0, .~,. é:jC:.~ <br />"'" v;¡ <br />i'i:M :J:) ¡::: ~ ORDINANCE 1995-~ <br />..~ é3~ <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING A 0.78 ACRE TRACT OF PROPERTY <br />LOCATED AT 2050 I.H. 35 SOUTH FROM "I" INDUSTRIAL <br />DISTRICT TO "C" COMMERCIAL DISTRICT AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On September 12, 1995, the Zoning Commission of the City of San Marcos held <br />a public hearing regarding a request to change the zoning from "I" Industrial District to "C" <br />Commercial District for a 0.78 acre tract of property located at 2050 LH. 35 South. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on September 12, 1995, consider and vote to approve the request, and <br />has recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 9th day of <br />October , 1995, regarding the request. <br />. <br /> <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, of the Code of <br />Ordinances of the City of San Marcos pertaining to amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of <br />the General Zoning Ordinance is amended to rezone the following real property which is <br />presently zoned "I" Industrial District to "C" Commercial District: <br /> <br />Street address: 2050 I.H. 35 South <br /> <br />Size: 0.78 acres. <br /> <br />Legal description: A portion of Lot 16, AF. Weatherford Subdivision, a metes and <br />bounds description of which is attached as Exhibit A <br /> <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its <br />passage and after it has been subject to reconsideration by the Council at its next regular <br />meeting following its passage, and provided that the Council did not vote to reconsider it. <br />If reconsidered on October 23, 1995 it shall be in effect ten days from and after its <br />passage on that date if approved. It shall not go into effect if denied. If not reconsidered <br />and approved it shall be published in a newspaper of general circulation in the area as <br />required by the Charter of the City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this 9th day of October , 1995, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />October 23, 1995. <br /> <br /> <br />Reconsidered yes no x <br /> <br />If yes approved <br />denied <br />date <br />
