MARCOS, TEXAS, AMENDING CHAPTER 16, MISCELLANEOUS <br />\ .~ Go'".> ãi OFFENSES AND PROVISIONS, OF THE SAN MARCOS CODE OF <br />ORDINANCES; BY ADDING SECTION 16-9, RESTRICTIONS ON <br />ACTIVITIES ON BRIDGES CROSSING THE BLANCO RIVER; INCLUDING <br />PROCEDURAL PROVISIONS AND PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />The City of San Marcos Police Department has determined that due to the large <br />number of individuals fishing by sitting, stopping or standing on the Uhland Road (CR. <br />161) crossing of the Blanco River, that a traffic and safety hazard for both pedestrians and <br />motorists exists. <br /> <br />BE IT ORDAINEp BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAs.: <br /> <br />SECTION 1. That Article I of Chapter 16, Miscellaneous Offenses and Provisions <br />is amended by adding Section 16-9 which reads as follows: <br /> <br />Sec. 16-9. Restrictions on activities on bridges crossing the <br />Blanco River. <br />~ <br /> <br /> <br />(a) It is unlawful for a person to fish from the Uhland Road bridge <br />crossing the Blanco River. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br />invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances and resolutions or parts of ordinances or <br />resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 4. That any person violating any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 5.
