<br />V1 <br />r.-¡ ~ ~~ 29 <br />D - .a:: .., <br />ti". - - ~ ':$ <br />I!!!I!Ir. c.;. <=> 0::,= <br />~a~ N ß~ ' <br />C;:: 'rJ' u;¡ <br />~ Eb 1:: ~ ORDINANCE 1995 - 62 <br />~ CJ? -- <br />~ ~~ <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING ARTICLE II, DEFINITIONS AND ARTICLE <br />VI, SUBDIVISION DESIGN REQUIREMENTS OF APPENDIX C- <br />SUBDIVISIONS OF THE SAN MARCOS CODE OF ORDINANCES TO <br />REVISE THE DEFINITION OF "FLAG SHAPED LOT" AND TO PROVIDE <br />EXCEPTIONS TO THE PROHIBITION OF SUCH LOTS WITHIN <br />SUBDIVISIONS; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING PENALTIES FOR VIOLATIONS. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS; <br /> <br />SECTION.1.. That Article II, Section B,25.c of Appendix C, Subdivisions, of the San <br />Marcos Code of Ordinances is amended to read as follows: <br /> <br />c. Lot. flag shaped: An irregularly shaped lot that takes its sole <br />access via a long, narrow stip of land connecting the principal <br />building site to a public street. <br /> <br />SECTION 2. That Article VI, Section H.9 of Appendix C, SubdÌvisions, of the San <br />Marcos Code of Ordinances is amended to read as follows: <br /> <br />9. Flag shaped lots are prohibited except where no other lot <br />access options are possible due to topography, flood plain or <br />similar limiting physical features. <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br />remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br />invalid portion had not been adopted. <br /> <br />SECTION 4. That all ordinances and resolutions or parts of ordinances or <br />resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 5. That any person violating any provision of this ordinanc~ shall be <br />deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br />provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> <br />SECTION 6.
