RESOLUTION 2012 -158R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS APPROVING THE <br />ISSUANCE OF A CERTIFICATE OF PUBLIC <br />CONVENIENCE AND NECESSITY TO EMMANUEL <br />JOHN, D /B /A AMERICO EXPRESS TRANSPORTATIN, <br />FOR THE PROVISION OF TAXICAB SERVICES IN SAN <br />MARCOS; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On December 4, 2012, the San Marcos City Council held a public hearing regarding an <br />application for a Certificate of Public Convenience and Necessity from Emmanuel John, d/b /a <br />Americo Express Transportation, for the provision of taxicab services in the City. <br />2. Subsequent to the public hearing on that date, the City Council finds and determines that <br />the applicant meets the requirements of Chapter 90, Article 3 of the San Marcos City Code <br />pertaining to the issuance of a taxicab business certificate of convenience and necessity have been <br />met by the applicant. <br />3. The City Council finds that this taxicab business is required to adequately serve the public <br />convenience and necessity and that the applicant is fit, willing and able to operate a taxi business and <br />to conform to the provisions of City ordinances. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The issuance of a Taxicab Business Certificate of Public Convenience and <br />Necessity to Emmanuel John, d/b /a Americo Express Transportation, is hereby approved. <br />PART 2. The City Clerk, Jamie Lee Pettijohn, is directed to issue a Taxicab Business <br />Certificate of Public Convenience and Necessity to Emmanuel John d/b /a Americo Express upon the <br />City Attorney's review and approval of proof of liability insurance coverage for the company. <br />PART 3.
