<br /> . 46 <br /> ¡ <br /> <br /> " <br /> Office of the City Manager <br /> November 14,1995 <br /> Bill Nance <br /> Vice President for Finance and <br /> Support Services <br /> Southwest Texas State University <br /> 601 University Drive <br /> San Marcos, TX 78666-4615 <br /> Re: Pecan Str~~t Right-of-Way <br /> Dear Mr. Nance: <br /> This letter, upon countersignature by an authorized official of Southwest Texas State <br /> University (the "University"), will constitute an agreement regarding proposed <br /> improvements to, and the proposed abandonment of, the segment of Pecan Street rìght-of- <br /> way located to the Southeast of Sessom Drive extending to Live OaK Street (the "Pecan <br /> Street segment"). The City owns this right-of-way by virtue of the platting and dedication <br /> of the Park Addition, First and Second Division, according to the plat filed in Volume 54, <br /> page 419, Hays County Deed Records. <br /> The University is the owner of all the property adjacent to the Pecan Street segment, <br /> except for a residential lot at 201 Pecan Street owned by Dr. John R. Ballard. The <br /> University is in the process of developing its property on both sides of this segment, and <br /> will be reconstructing this segment as a part of its project. <br /> The City's ordinances governing construction within City rights-of-way normally require <br /> roadway reconstruction to be designed by a registered engineer in conformance with the <br /> City's Manual for Design and Construction. The University has submitted an application <br /> to the City to request that the City abandon and sell its interest in the Pecan Street <br /> segment to the University. On this basis, the City and the University agree as follows: <br /> , <br /> 1. The City agrees to allow the University to reconstruct the Pecan Street <br /> segment to the University's own specifications, provided that the new <br /> intersection of Pecan Street and Sessom Drive will conform to the City's <br /> standards for public right-of-way access. <br /> 2. The City agrees to process the University's request for abandonment of the <br /> Pecan Street segment in accordance with the City's ordinance on <br /> abandonment of streets and alleys. <br /> 630 East Hopkins.
