<br /> ?)ò8 <br /> -3- <br /> Sec. 2-140. Scope of commission review authority. <br /> (a) All city boards, commissions and committees are subject to this <br /> division except the following: <br /> (1) A city board, commission or committee appointed by the city <br /> council for a limited purpose, that will automatically dissolve <br /> upon completion of that purpose. <br /> (2) A city board, commission or committee established under the <br /> city charter. <br /> (3) The citizen review commission, and any other city board, <br /> commission or committee that is expressly excepted from <br /> application of this division by the city council. <br /> (b) This division does not prohibit the city council from terminating or <br /> abolishing a city board, commission or committee subject to this <br /> division before a recommendation or a written report on the city <br /> board, commission or committee has been received by the city council <br /> from the commission. This division also does not prohibit the city <br /> council from considering any other recommendations, reports, <br /> changes or modifications relative to a city board, commission or <br /> committee subject to this division. <br /> Sec. 2-141. Assistance of and access to city employees. <br /> The commission may request the assistance of any city employee. The city <br /> employee will assist the commission when requested and when assistance is <br /> determined by the chairperson of the commission and the mayor to be essential <br /> and necessary to the commission's performance of its functions as provided for <br /> in this division. <br /> Sec. 2-142. Dissolution of commission. <br /> Each citizen review commission will be automatically dissolved when it <br /> presents its report to the city council and the report is formally received and <br /> accepted by the city council. <br /> SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> remaining provisions of this ordinance shall remain in effect as if the unconstitutional or <br /> invalid portion had not been adopted. <br /> SECTION 3. That all ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict herewith are hereby repealed. <br /> SECTION 4. That any person violating any provision of this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be subject to the penalty <br /> provided in Section 1-5 of the San Marcos Code of Ordinances. <br /> SECTION 5. That this Ordinance shall be in effect ten (10) days from and after its <br /> passage, and it shall be published in a newspaper of general circulation in the area as <br /> required by the Charter of the City of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading October 23, 1995. <br />
