ORDINANCE 1995- "71 <br />..::- ',:.) ~ - <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING A 0,98 ACRE TRACT OF <br />PROPERTY LOCATED AT 31 0 WEST HUTCHISON STREET <br />FROM "P" PUBLIC AND INSTITUTIONAL DISTRICT TO "C" <br />COMMERCIAL DISTRICT AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECITALS: <br /> <br />1. On October 1 0, 1995, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "P" Public and <br />Institutional District to "C" Commercial District for a 0,98 acre tract of property located at <br />310 West Hutchison Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on October 1 0, 1995, consider and vote to deny the request, and has <br />recommended that the request be denied by the City Council of the City, <br /> <br />3, The City Council held a public hearing on the 11th day of <br />December , 1995, regarding the request. <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, of the Code of <br />Ordinances of the City of San Marcos pertaining to amendments have been met. .. <br /> <br />5, The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1, That the Official Zoning Map of the City, as described in Section 3 of <br />the General Zoning Ordinance is amended to rezone the following real property which is <br />presently zoned "P" Public and Institutional District to "C" Commercial District: <br /> <br />Street address: 310 West Hutchison Street <br /> <br />Size: 0.98 acres, <br /> <br />Legal description: Lot 27, Original Town of San Marcos. <br /> <br />Deed or plat reference: Volume 46, page 448, Hays County Deed Records. <br /> <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its <br />passage and after it has been subject to reconsideration by the Council at its next regular <br />meeting following its passage, and provided that the Council did not vote to reconsider it. <br />If reconsidered on January 8, 1996 it shall be in effect ten days from and after its <br />passage on that date if approved. It shall not go into effect if denied. If not reconsidered <br />and approved it shall be published in a newspaper of general circulation in the area as <br />required by the Charter of the City of San Marcos, Texas, <br /> <br />PASSED, APPROVED AND ADOPTED this. 1 tltrlay of December , 1995, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />January 8, 19,96. <br /> <br />Reconsidered yes no x <br />
