<br /> LJ~f1- <br /> alcoholic beverages for on-premise consumption <br /> requires issuance of a new specific use <br /> permit. <br /> (a) The State TABC license is re-issued under <br /> a different permit-holder's name. <br /> (b) The specific use permit is forfeited, <br /> suspended, or revoked in accordance with <br /> the provisions of Section 35(H) (3). <br /> (c) There is a significant change in the name <br /> of the establishment, or any physical or <br /> operational change in the business that <br /> increases off-site impacts to surrounding <br /> properties. <br /> SECTION 2. That Section 35(H) (3) (a) (4), of Appendix A, <br /> General Zoning Ordinance, of the San Marcos Code of <br /> Ordinances is amended with regard to the conditions of <br /> specific use permits for establishments dispensing alcoholic <br /> beverages for on-premise consumption to read as follows: <br /> (3) Establishments dispensing alcoholic beverages for <br /> on-premise consumption. <br /> (a) Procedures <br /> (4) The Commission shall act on'a completed <br /> application within 30 days of the <br /> submission of the application to the <br /> Director, unless an application is placed <br /> on a waiting list for consideration of <br /> permits in the CBA district when the <br /> limit of 15 specific use permits has been <br /> reached, or unless an application is <br /> delayed at the request of the applicant. <br /> when a permit is authorized by the <br /> Commission, it shall be issued by the <br /> Director only' after a TABC license is <br /> issued to the permittee by the State, and <br /> a copy of the license is submitted to the <br /> Director. <br /> SECTION 3. That Section 35 (H) (3), of Appendix A, <br /> General Zoning Ordinance of the San Marcos Code of Ordinances <br /> is amended to delete subparts (d) and (f) in their entirety <br /> with regard to TABC specific use permit renewal, review and <br /> suspension, to redesignate subpart (e) as subpart (d), to add <br /> a new subpart (e) to read as follows, and to redesignate <br /> subpart (g) as subpart (f): <br /> (e) Revocation: <br /> 1. The Director shall cause a revocation <br /> hearing to be scheduled before the <br /> Commission in accordance with the same <br /> procedures as for initial consideration <br /> of a specific use permit when either of <br /> the following situations occur. These <br /> provisions supersede any conflicting <br /> provisions in Section 35(F). <br /> (a) An establishment having a valid TABC <br /> specific use permit violates any <br /> prOVlSlon of the permit, including <br /> conditions established by the <br /> Commission in approving the specific <br /> use permit which may not otherwise <br /> be addressed in the mandatory <br /> standards enumerated in subsection <br /> (b) . <br />
