LJ~f1- alcoholic beverages for on-premise consumption requires issuance of a new specific use permit. (a) The State TABC license is re-issued under a different permit-holder's name. (b) The specific use permit is forfeited, suspended, or revoked in accordance with the provisions of Section 35(H) (3). (c) There is a significant change in the name of the establishment, or any physical or operational change in the business that increases off-site impacts to surrounding properties. SECTION 2. That Section 35(H) (3) (a) (4), of Appendix A, General Zoning Ordinance, of the San Marcos Code of Ordinances is amended with regard to the conditions of specific use permits for establishments dispensing alcoholic beverages for on-premise consumption to read as follows: (3) Establishments dispensing alcoholic beverages for on-premise consumption. (a) Procedures (4) The Commission shall act on'a completed application within 30 days of the submission of the application to the Director, unless an application is placed on a waiting list for consideration of permits in the CBA district when the limit of 15 specific use permits has been reached, or unless an application is delayed at the request of the applicant. when a permit is authorized by the Commission, it shall be issued by the Director only' after a TABC license is issued to the permittee by the State, and a copy of the license is submitted to the Director. SECTION 3. That Section 35 (H) (3), of Appendix A, General Zoning Ordinance of the San Marcos Code of Ordinances is amended to delete subparts (d) and (f) in their entirety with regard to TABC specific use permit renewal, review and suspension, to redesignate subpart (e) as subpart (d), to add a new subpart (e) to read as follows, and to redesignate subpart (g) as subpart (f): (e) Revocation: 1. The Director shall cause a revocation hearing to be scheduled before the Commission in accordance with the same procedures as for initial consideration of a specific use permit when either of the following situations occur. These provisions supersede any conflicting provisions in Section 35(F). (a) An establishment having a valid TABC specific use permit violates any prOVlSlon of the permit, including conditions established by the Commission in approving the specific use permit which may not otherwise be addressed in the mandatory standards enumerated in subsection (b) .
