PUBLICITY <br /> DYNIX agrees to submit to THE CITY all press releases, advertising, sales promotions, and other publicity <br /> matters related to any product furnished by DYNIX to THE CITY wherein THE CITY's name is mentioned, <br /> excluding the DYNIX customer list and newsletter. DYNIX shall not publish nor knowingly permit to œ <br /> published any such material without the prior written consent of THE CITY. <br /> 28. DA Y El"m PROCESSING <br /> DYNIX commits that day-.:md processing (DEP) can œ completed in no more than eight (8) hours without <br /> staff intervention during the process, as long as THE CITY remains within the parameters of the RFP, <br /> retains no more than one hundred (100) days of daily statistics, no more than one hundred eighty (180) days <br /> of ?URF history data and maintains no more than two (2) circulation accounts. If these above conditions <br /> are not met, DYNIX cannot guarantee the time to run DE? Failure of the system to complete daily DE? <br /> within eight (8) hours shall result in DYNIX tuning or upgrading the System at its expense. <br /> 29. PRICE PROTECTION AND RENTAL OPTION <br /> DYNIX shall provide software, terminals, PCs, side printers, Tdxons, lasèr scanners, lightpens, and <br /> Electronic Notification System (ENS) at prices not to exceed these included in the DYNIX Proposal, Section <br /> D for a period of fifteen (15) months from the successful completion of the Hardware Functionality Test, <br /> providing that it shall not be liable to provide equipment which is not longer œing manufactured or which <br /> is no longer œing carried by DYNIX. <br /> DYNIX shall provide THE CITY an option to rent the Electronic Notification System (ENS) including <br /> hardware, software and maintenance services at a price of $380 per month with a minimum three (3) month <br /> THE CITY OF SAN MARCOS.
