All such work shall be.', <br /> subject to permit, inspection, and approval in, -- <br /> accordance with the terms of this Article. ~- <br /> -. <br /> " <br /> SECTION 4. That subsection (c) of Section 5-152 of the San <br /> Marcos Code of Ordinances is amended to read as follows: <br /> (c) Maintenance electrician - Persons applying for <br /> a maintenance electrician's license shall be <br /> interviewed by the electrical board and licenses <br /> shall be issued according to criteria approved and <br /> published by the board for all maintenance <br /> electricians. <br /> SECTION 5. That Section 5-167 of the San Marcos Code of <br /> Ordinances is amended by revising subsection (b) (3), and by adding <br /> a new subsection (d), to read as follows: <br /> (b) (3) A property owner who certifies that the <br /> work will be performed by the applicant's own <br /> hands, in a residence owned and occupied by the <br /> applicant. <br /> (d) A minimum permit fee in an amount set by <br /> separate ordinance shall be charged when the cost <br /> of the electrical work to be performed does not <br /> exceed $250.00. <br /> SECTION 6. That Section 5-168 (c) of the San Marcos Code of <br /> Ordinances is amended to read as follows: <br /> (c) In the event of the death or other inability <br /> of the responsible master electrician holding the <br /> permit to supervise work under the permit: <br /> (1) The work under the permit may be continued for <br /> a period not to exceed six months if another master <br /> electrician already working on the proj ect or the <br /> lead journeyman on the project assumes <br /> responsibility for the completion of the work ln <br /> accordance with approved electrical plans and the <br /> requirements of this code; or <br /> (2) All work shall cease immediately if no other <br /> licensed master electrician or journeyman was <br /> working on the project prior to the death or other <br /> inability of the permit holder. In this case the <br /> permit may be assigned to another master <br /> electrician upon the request of the project owner <br /> and upon approval of the board, notwithstanding the ' <br /> provisions of Sections 5-133(b) and 5-170. <br /> SECTION 7. That the amount of the minimum electrical permit <br /> fee under Section 5-167(d) of the San Marcos Code of Ordinances is <br /> set at $5.00. <br /> SECTION 8. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 9. That all ordinances or parts of ordinances in <br /> conflict with this ordinance are hereby repealed. <br />
