That subdivision (2) of Section 5-151 of the .San : Marcos Code of Ordinances is amended to read as follows: (2) A property owner may perform electrical work '. -- with the owner's own hands in a residence owned and. . ~ occupied by the owner. All such work shall be.', subject to permit, inspection, and approval in, -- accordance with the terms of this Article. ~- -. " SECTION 4. That subsection (c) of Section 5-152 of the San Marcos Code of Ordinances is amended to read as follows: (c) Maintenance electrician - Persons applying for a maintenance electrician's license shall be interviewed by the electrical board and licenses shall be issued according to criteria approved and published by the board for all maintenance electricians. SECTION 5. That Section 5-167 of the San Marcos Code of Ordinances is amended by revising subsection (b) (3), and by adding a new subsection (d), to read as follows: (b) (3) A property owner who certifies that the work will be performed by the applicant's own hands, in a residence owned and occupied by the applicant. (d) A minimum permit fee in an amount set by separate ordinance shall be charged when the cost of the electrical work to be performed does not exceed $250.00. SECTION 6. That Section 5-168 (c) of the San Marcos Code of Ordinances is amended to read as follows: (c) In the event of the death or other inability of the responsible master electrician holding the permit to supervise work under the permit: (1) The work under the permit may be continued for a period not to exceed six months if another master electrician already working on the proj ect or the lead journeyman on the project assumes responsibility for the completion of the work ln accordance with approved electrical plans and the requirements of this code; or (2) All work shall cease immediately if no other licensed master electrician or journeyman was working on the project prior to the death or other inability of the permit holder. In this case the permit may be assigned to another master electrician upon the request of the project owner and upon approval of the board, notwithstanding the ' provisions of Sections 5-133(b) and 5-170. SECTION 7. That the amount of the minimum electrical permit fee under Section 5-167(d) of the San Marcos Code of Ordinances is set at $5.00. SECTION 8. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 9. That all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.
