<br /> -2- <br /> (g) The terms of office of council members shall be <br /> staggered so that. two members are elected to a regular term <br /> each year. <br /> Sec. 3.02. Qualifications. <br /> (a) Each member of the city council, in addition to <br /> having other qualifications prescribed by law: <br /> ( 2) Shall have resided for at least one (1) year <br /> preceding the election within the city, and <br /> for council districts one through four, within <br /> the respective district; or shall have been a <br /> resident for a period of at least one year <br /> immediately preceding the election of any <br /> territory annexed to the city, or to the city <br /> and the respective council district, during <br /> the one year period; <br /> Sec. 5.04. The official ballot. <br /> The names of all candidates for office, except those that <br /> have withdrawn, died, or become ineligible, shall be <br /> printed on the official ballots without party designation. <br /> The order on the ballot of the names of the candidates for <br /> each respective council place shall be determined by lot in <br /> a drawing to be held under the supervision of the city <br /> secretary, which each candidate or the candidate's named <br /> representative may attend. Incumbent council members in <br /> Places 5 or 6 seeking reelection must file for the Place <br /> for which they were originally elected. An incumbent <br /> council member in Place 1, 2, 3, 4, 5 or 6 may file for the <br /> position of mayor and an incumbent mayor may file for <br /> election as council member for Place 5 or 6, or as council <br /> member for Place 1, 2, 3 or 4 as a resident of the <br /> respective council district. <br /> Sec. 6.07. Power of recall. <br /> The people of the city reserve the power to recall any <br /> elected officer of the City of San Marcos and may exercise <br /> such power by filing a petition with the city secretary. <br /> A petition for the recall of a mayor or a council member in <br /> an at large position must be signed by at least ten (10) <br /> per cent of the qualified voters of the City, and a <br /> petition for the recall of a council member In a council <br /> district position must be signed by at least ten (10) per <br /> cent of the qualified voters of the respective council <br /> district. The petition required for the recall of any <br /> elected official of the City of San Marcos shall be <br /> provided only by the city secretary. No signature shall be <br /> counted where there is reason to believe it is not the <br /> actual signature of the purported signer or that it is a <br /> duplication either of name or handwriting used in any other <br /> signature on the petition, and no signature shall be <br /> counted unless it is accompanied by all of the information <br /> required by applicable state law. Before signatures on any <br /> recall petition form may be counted, one ( 1) of the <br /> signers of such petition paper, a qualified voter In the <br /> City of San Marcos, shall make oath before the city <br /> secretary, that the statements made therein are true, that <br /> each signature to the paper appended is the genuine <br /> signature of the person whose name purports to be signed <br /> thereto, and that such signatures were placed thereon in <br /> the affiant's presence. Any recall petition form supplied <br /> by the city secretary shall be valid for thirty (30) days <br /> from the date of its issuance and the expiration date and <br /> time shall be noted on the petition form by the city <br />
