the survey attached as Exhibit "B ", is approved: <br />a. 50' x 445'section of Rush Haven between Golden Shadow and Morning Shadow; <br />b. 50' x 433'section of Morning Shadow; <br />C. 80' x 100' section of Morning Shadow; <br />d. 50' x 84' section of Trestle Tree <br />SECTION 2. The City Council determines that the proposed abandonment of the Property <br />complies with the requirements of Chapter 74, Division 3, of the San Marcos City Code. <br />SECTION 3. The City Manager is authorized to execute a quitclaim deed conveying the <br />Property to the owner or owners of the "Property." The payment by such owner(s) of the fair market <br />value of the property is hereby waived. The City shall reserve a public utility easement over the <br />Property from the conveyance in the quitclaim deed. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5: All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 6. This Ordinance will take effect immediately after the date of its final passage <br />or publication if publication is required by state law. <br />PASSED AND APPROVED on first reading on December 4, 2012. <br />PASSED, APPROVED AND ADOPTED on second reading on December 18, 2012. <br />iel Guerrero <br />Mayor <br />
