ORDINANCE NO. 2012-56 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AMENDED AND RESTATED <br />PLANNED DEVELOPMENT DISTRICT STANDARDS FOR THE <br />RETREAT ON WILLOW CREEK PLANNED DEVELOPMENT <br />DISTRICT CONSISTING OF 101.40 ACRES OF LAND, MORE OR LESS, <br />IN THE J.M. VERAMENDI SURVEY NO. 1, ABSTRACT NO. 17 <br />LOCATED NEAR HUNTER ROAD AND STAGECOACH TRAIL AS <br />ORIGINALLY APPROVED BY ORDINANCE NO. 2009 -81 FOR THE <br />PURPOSES OF ALLOWING ONLY SINGLE - FAMILY USES, <br />AMENDING ARCHITECTURAL, LANDSCAPING AND TREE <br />PRESERVATION AND MITIGATION STANDARDS AND PROVIDING <br />FOR A BUFFER BETWEEN HOUSING BUILT IN THE DISTRICT AND <br />ADJACENT RESIDENCES; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. On October 23, 2012 the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to amend the Development Standards for the <br />Retreat on Willow Creek Planned Development District, consisting of 101.40 acres of land, more <br />or less, in the J.M. Veramendi Survey No. 1, Abstract No. 17 located near Hunter Road and <br />Stagecoach Trail (the "Project Site," as described in Exhibit "A," attached hereto and made a <br />part hereof) as originally approved by Ordinance No. 2009 -81 for the purposes of allowing only <br />single - family uses, establishing residential architectural, landscaping and tree preservation and <br />mitigation standards and providing for a buffer between housing built in the district and adjacent <br />residences. <br />2. Subsequent to the public hearing, the Planning and Zoning Commission, on <br />November 13, 2012 considered and voted to recommend that the request be approved by the City <br />Council of the City of San Marcos. <br />3. The City Council held a public hearing on December 4, 2012 regarding the <br />request. <br />4. All applicable requirements of Chapter 1, Development Procedures, of the City <br />Land Development Code have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />
