<br />133 <br /> <br />RESOLUTION 1994- 47 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF A SUBSTATION PURCHASE AND <br />OPERATING AGREEMENT BETWEEN THE CITY AND THE <br />LOWER COLORADO RIVER AUTHORITY; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />RECITALS <br /> <br />1. LCRA is the owner of certain electric substations in and <br />around San Marcos which are used or may be used in the future for <br />the delivery of bulk electric power and energy to San Marcos. <br /> <br />" . <br /> <br />2. In a letter dated April 26, 1993, LCRA submitted a <br />proposal to San Marcos in order to resolve certain issues in <br />connection with the right of San Marcos to purchase certain <br />electric substation sites and substation facilities from LCRA. <br /> <br />3. LCRA has agreed to convey to San Marcos all of the, real <br />property consisting of the electric substation sites. commonly known <br />as "Ranch Road 12", "Hilltop" and "Bugg Lane". <br /> <br />4. LCRA has agreed to sell to San Marcos all of LCRA's right, <br />title and interest in certain personal property situated within the <br />electric substations commonly known as "Ranch Road 12", "Hilltop", <br />"San Marcos", "Redwood" and "Bugg Lane". <br /> <br />5. LCRA has an obligation for the continued service to <br />Bluebonnet Electric Cooperative from the Redwood SUbstation, the <br />reliability of which will be enhanced by the Agreement attached to <br />this Resolution. <br /> <br />6. The Agreement attached to this Resolution resolves all <br />issues relating to the purchase, operation and maintenance, and use <br />rights of those substation sites and facilities. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the terms and conditions of the Substation <br />Purchase and Operating Agreernent attached to this Resolution <br />between the city and the Lower Colorado River Authority are <br />approved. <br /> <br />PART 2. That the City Manager, Larry D. Gilley, is authorized <br />to execute this Agreement on behalf of the city. <br /> <br />PART 3.
