<br />147 <br /> <br />RESOLUTION 1994- <br /> <br />55 <br /> <br />R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE 'CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN EMERGENCY PROCUREMENT <br />OF WASTEWATER SAMPLING SERVICES TO PRESERVE AND <br />PROTECT THE PUBLIC HEALTH AND SAFETY OF THE CITY'S <br />RESIDENTS; APPROVING THE TERMS AND CONDITIONS OF AN <br />AGREEMENT WITH NATIONAL ENVIRONMENTAL TESTING, <br />INC.; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City is under a 120 day moratorium on the <br />assessment and collection of sewer surcharge fees. <br /> <br />2. In order to adequately assess the amount of <br />surcharge fees to be charged after the moratorium is over it <br />is necessary for the City to complete the collection and <br />analysis of 225 composited wastewater samples. <br /> <br />3. The City does not have the required staff to <br />complete the collection and analysis within the 120 day time <br />frame. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />PART 1. That the emergency procurement of services <br />for the collection and analysis of wastewater samples in the <br />City of San Marcos in order to preserve and protect the <br />public health and safety of the City's residents is approved. <br /> <br />PART 2. That an agreement between the City and <br />National Environmental Testing, Inc. for this service, a copy <br />of which is attached to and incorporated in this Resolution <br />for all intents and purposes, is approved. <br /> <br />PART 3. That the City Manager, Larry D. Gilley, is <br />authorized to execute the attached agreement on behalf of <br />the City. <br /> <br />PART LI.
