ORDINANCE NO. 2003- /4.7 <br /> <br />AN ORDiNANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING 1.70 ACRE AND <br />2.631 ACRE TRACTS OF LAND LOCATED AT 1909 AND <br />1913 DUTTON DRIVE FROM "LI" LIGHT INDUSTRIAL <br />DISTRICT TO "C" COMMERCIAL DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />47. <br /> <br />60-< ~ <br /> <br />o <br /> <br />RECITALS: <br /> <br /> 1. On July 29, 2003, the Plmming and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning fi'om "LI" Light Industrial District <br />to "C" Commercial District for 2.631 and 1.70 acre tracts of land located at 1909 and 1913 <br />Dutton Drive. <br /> <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on July 29, 2003 consider and vote to approve the request, and has recommended that the <br />request be approved by the City Council of the City. <br /> <br /> 3. The City Council held a public hearing on the 25th day of <br />2003, regarding the request. <br /> <br />August , <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map mnendments have been met. <br /> <br /> 5. The City Cotmcil hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare aud safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to rezone the following real property which is presently <br />zoned "LI" Light Industrial District to "C" Commercial District: <br /> <br />Tract 1: <br /> <br />Street address: 1909 Dutton Drive <br /> <br />Size: 1.70 acres <br /> <br />Legal description: Lot 5, Block 1, Section Two, of the San Marcos Business Park <br />Subdivision <br /> <br /> <br />
