48, ORDINANCE NO. 2003- 48 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 10.95 ACRE TRACT OF PROPERTY LOCATED AT THE WESTERN END OF LEAH AVENUE AND CLOVERLEAF STREET AND THE NORTHERN END OF BELMONT STREET FROM "R-I" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO "R-2" SINGLE-FAMILY DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On July 29, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "R-I" Single-Family Dwelling District (Low Density) to "R-2" Single-Family Dwelling District (Medium Density) for a 10.95 acre tract of property located at the western end of Leah Avenue and Cloverleaf Street and the northern end of Belmont Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on July 29, 2003 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 25'ch day of August ,2003, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "R-I" Single-Family Dwelling District (Low Density) to "R-2" Single-Family Dwelling District (Medium Density): Street address: Terminus of Leah Avenue Size: 10.95 acres
