48, <br /> <br />ORDINANCE NO. 2003- 48 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING A 10.95 <br />ACRE TRACT OF PROPERTY LOCATED AT THE <br />WESTERN END OF LEAH AVENUE AND CLOVERLEAF <br />STREET AND THE NORTHERN END OF BELMONT <br />STREET FROM "R-I" SINGLE-FAMILY DWELLING <br />DISTRICT (LOW DENSITY) TO "R-2" SINGLE-FAMILY <br />DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />RECITALS: <br /> <br /> 1. On July 29, 2003, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "R-I" <br />Single-Family Dwelling District (Low Density) to "R-2" Single-Family Dwelling District <br />(Medium Density) for a 10.95 acre tract of property located at the western end of Leah <br />Avenue and Cloverleaf Street and the northern end of Belmont Street. <br /> <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on July 29, 2003 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 25'ch day of <br />August ,2003, regarding the request. <br /> <br /> 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code <br />pertaining to zoning map amendments have been met. <br /> <br /> 5. The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. The Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real property <br />which is presently zoned "R-I" Single-Family Dwelling District (Low Density) to "R-2" <br />Single-Family Dwelling District (Medium Density): <br /> <br />Street address: Terminus of Leah Avenue <br /> <br />Size: 10.95 acres <br /> <br /> <br />
