On March 1, 1994, the zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the <br /> zoning from "TH-1" Townhouse Residential District to "DP-1" Two- <br /> Family Dwelling District (Low Density) for a 0.37 acre tract of <br /> property located at 110 Endicott Street. <br /> 2. Subsequent to the public hearing on that date, the zoning <br /> commission did, on March 1, 1994 consider the request and voted to <br /> approve and has recommended that the request be approved by the <br /> city Council of the city. <br /> 3. The city Council held a public hearing OTh the 11th day <br /> of April , 1994, regarding the request. <br /> 4. All requirements of Appendix A, General Zoning Ordinance, <br /> of the Code of Ordinances of the City of San Marcos pertaining to <br /> amendments have been met. <br /> 5. The City Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the <br /> public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Official zoning Map of the city, as <br /> described in section 3 of the General Zoning Ordinance, is hereby <br /> amended to rezone the following real property which is presently <br /> zoned "TH-1" Townhouse Residential District to "DP-1" Two-family <br /> Dwelling District (Low Density): <br /> Street address: 110 Endicott Street <br /> Size: 0.37 acre <br /> Leqal description: Lot 2 and a portion of Lots 3, 4, 5 <br /> and 6 of BIMMS Addition, a metes and bounds description <br /> of which is attached as Exhibit A. <br /> Deed or plat reference: Volume 3, page 381, Hays County <br /> Plat Records. <br /> SECTION 2. That this Ordinance shall be in effect ten (10) <br /> days from and after its passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br /> following its passage, and provided that the Council did not vote <br /> to reconsider it. If reconsidered on April 25, 1994 it shall be <br /> in effect ten days from and after its passage on that date if <br /> approved. It shall not go into effect if denied. If not <br /> reconsidered and approved it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the <br /> City of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 11th day of April, 1994, <br /> subject to reconsideration at the next regular City Council meeting <br /> scheduled for April 25, 1994 . <br />
