(4) If the industrial user fails to fulfill the conditions of the proscribed compliance plan, <br />it may be fbund in violation of this division and subject to penalties and enfomement actions as <br />described in section 86.117. <br /> <br />(d) Pretreatment. <br /> <br /> (1) If pretreatment or control is required, the control authority shall review and either <br />accept or deny the proposed design and installation of equipment and processes. Acceptance of <br />a proposed pretreatment plan by the control authority shall not relieve the industrial user of <br />responsibility and/or liability for failure of that pretreatment to achieve acceptable discharge. <br /> <br /> (2) The design and installation of equipment and processes must conform to all <br />applicable statutes, codes, ordinances and other laws. <br /> <br /> (3) Any industrial user responsible for discharges requiring pretreatment, flow equalizing <br />or other facilities shall provide and maintain the facilities in effective operating condition at its <br />own expense. <br /> <br /> (4) Persons discharging industrial wastes which exhibit none of the characteristics of <br />wastes prohibited in this division other thtu~ excessive BOD or TSS may be required to pretreat <br />the industrial wastes to meet the requirements of normal domestic waste. <br /> <br />(e) Plans and specifications. The approval of plans by the director will in no way relieve a person <br />of the responsibility for modifying the structure once constructed as necessary to produce an <br />effluent acceptable to the director under this division. <br /> <br />Sec. 86.128. Excessive discharge/dilution. <br /> <br />No industrial user shall ever increase the use of process water or in any other way attempt to <br />dilute a wastewater discharge as a partial or complete substitute for adequate treatment to achieve <br />compliance with pretreatment standards except as authorized in 40 CFR 403.6(d). Although <br />waste streams may be mixed prior to discharge to the POTW, no industrial user may dilute for <br />the express purpose of compliance with discharge limits. The director may further restrict the <br />discharges to a definite limit expressed in the units of"pounds per day" to prevent employment <br />of dilution in lieu of treatment. <br /> <br />Sec. 86.129. Accidental discharges. <br /> <br />(a) Each user required to obtain a user permit under this division or as determined by the city, <br />shall provide protection from accidental discharge of prohibited materials or other substances <br />regulated by this division and other approved standards. Facilities to prevent accidental <br />discharge of prohibited materials shall be provided and maintained at the owner or user's own <br />cost and expense. <br /> <br />27 <br /> <br /> <br />
