<br /> I 75ft <br /> EMERGENCY INTERCONNECTION AGREEMENT <br /> BETWEEN THE CITY OF SAN MARCOS AND <br /> MAXWELL WATER SUPPLY COMPANY <br /> RECITALS: <br /> 1. Maxwell Water Supply Corporation ("Maxwell") desires an <br /> emergency interconnection water source with the City of San Marcos <br /> ("City") public water supply for Maxwell's water system. <br /> 2. The Texas Department of Health Division of Water Hygiene has <br /> J approved such an interconnection between the water systems of <br /> 8 Maxwell and the City. <br /> The City and Maxwell hereby agree as follows: <br /> 1. Maxwell shall present to the City's Director of Public Works <br /> all p 13.;, I:' anr:l. òesigns fo!:" the interconnection. Maxwell shall bear all costs and fees for the design, <br /> cons':ruction, installation and maintenance of the <br /> int. :connection. This includes, but is not limited to, costs and <br /> fee' for labor, mate!:"ials, and licenses and any and all incidental <br /> or :msequential expenses or damages incurred for the ,design, <br /> con ruction, installation and maintenance of the. interconnection. <br /> 3. lxwell shall use the interconnection as a water source only <br /> wh",: .{axwell' s well ceases to function and such cessation is <br /> UTI3-- .dable and unintentional. <br /> 4. axwell's use of the interconnection as a water source shall <br /> not .xceed a period of fifteen (15) days per occurrence. If such <br /> USE. =xceeds fifteen (15) days, the City may either close the <br /> in- .:-connection or terminate this agreement at any time without <br /> I nc -ce. <br /> 5. Maxwell shall pay the City for all water passing through the <br /> interconnection. Payment shall be in accordance with the <br /> out-af-city user rate charged by the City during the period of <br /> use. Payment shall be due at the end of the month following use. <br /> 6. Maxwell shall install and maintain at its sole expense a meter <br /> to measure the number of gallons passing through the <br /> interconnection, a check valve both before and after the meter, <br /> and a locking device on both check valves. Keys to the locks <br /> shall be held by both the City and Maxwell. <br /> 7. Maxwell shall unlock the valves and flush its line on a <br /> monthly basis so as to assure readiness of a supply of fresh water <br /> and to prevent possible contamination of both systems due to stale <br /> water. <br /> 8. If Maxwell intends to use the interconnection, except to flush <br /> its line, Maxwell shall notify the City's Director of Public Works <br /> prior to each occurrence, and if the Director is unavailable, then <br /> Maxwell shall notify the City's Police Department. <br />
