EMERGENCY INTERCONNECTION AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND ~~WELL WATER SUPPLY COMPANY RECITALS: 1. Maxwell Water Supply Corporation ( "Maxwe 11 ") desires an emergency interconnection water source with the City of San Marcos ("City") public water supply for Maxwell's water system. 2. The Texas Department of Health Division of Water Hygiene has t approved such an interconnection between the water systems of II Maxwell and the City. The City and Maxwell hereby agree as follows: 1. Maxwell shall bear all costs and fees for the design, con;::-:ruction, installation and maintenance of the int 'connection. This includes, but is not limited to, costs and fee for labor, materials, and licenses and any and all incidental or ~nsequential expenses or damages incurred for the design, cor: ruction, installation and maintenance of the interconnection. 3. lxwell shall use the interconnection as a water source only wh,=: 1axwell's well ceases to function and such cessation is un.::. dable and unintentional. 4. 3.xwell's use of the interconnection as a water source shall not xceed a period of fifteen (15) days per occurrence. Maxwell shall pay the City for all water passing through the interconnection. Payment shall be In accordance with the out-of-cj'~l' use::::- rate charged by the City during the period of use. Payment shall be due at the end of the month following use. 6. Maxwell shall install and maintain at its sole expense a meter to measure the number of gallons passing through the interconnection, a check valve both before and after the meter, and a locking device on both check valves. Keys to the locks shall be held by both the City and Maxwell. 7. Maxwell shall unlock the valves and flush its line on a monthly basis so as to assure readiness of a supply of fresh water and to prevent possible contamination of both systems due to stale water. 8. If Maxwell intends to use the interconnection, except to flush its line, Maxwell shall notify the City's Director of Public Works prior to each occurrence, and if the Director is unavailable, then Maxwell shall notify the City's Police Department.
