CI:I <br />-. .:..:I >- en - <br />II. -:-i :;; ~ Q <br />~ - -.2:- <br />"'Ii. c:.;¡~ <br />ORDINANCE 1994- 32 \ <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND <br />DECLARING RESULTS OF THE SPECIAL AND GENERAL <br />ELECTION HELD ON MAY 7, 1994 FOR THE PURPOSE, <br />OF ELECTING A MAYOR, A CITY COUNCIL MEMBER, <br />- PLACE FIVE, AND A CITY COUNCIL MEMBER, PLACE <br />SIX AND SUBMITTING TO THE VOTERS VARIOUS <br />PROPOSITIONS INCLUDING PROPOSED AMENDMENTS TO <br />THE CITY CHARTER AND A PROPOSAL PERTAINING TO <br />THE USE OF A PROPOSED ACTIVITY CENTER ON PARK <br />PROPERTY; AND DECLARING AN EMERGENCY. <br /> <br /> <br />RECITALS: ' <br /> <br />1. The city Council ordered that a Special and General election <br />be held on May 7, 1994 for the purpose of electing a Mayor, a city <br />Council Member, Place Five and a city Council Member, Place six and <br />submitting to the voters various propositions including proposed <br />amendments to the City Charter and a proposal pertaining to the use <br />of a proposed activity center on park property. ~ <br /> <br />2. Notice of this election was duly published in the San Marcos <br />Daily Record on April 10, 1994 and April 17, 1994. <br /> <br />3. Copies of this notice were duly posted at each city election <br />precinct polling place prior to the election, and a copy of the <br />notice was posted on the bulletin board at city Hall on April 12, <br />1994; and, <br /> <br />4. This election was duly and legally held on the 7th day of May, <br />1994, in conformity with the election laws of the State of Texas, <br />and the results of the election have been certified and returned by <br />the proper judges and clerks. . <br /> <br />5. The City Council of the City of San Marcos, Texas with the <br />following members present: Kathy M. Morris, Billy G. Moore, Fred <br />Guerra, Ron Hart and Bill Plummer -- <br />and has today considered the returns of the <br />Special and General election held on the 7th day of May, 1994. <br /> <br />6. It appears to the council, and the Council finds, that the <br />election was in all respects lawfully held. <br /> <br />7. It appears to the Council, and the Council finds, that the <br />tabulation of the results of the election is correct. <br /> <br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the Special and General City election of May <br />7, 1994 was duly called, that notice of the election was given in <br />accordance with law, and that the election was held in accordance <br />with law. <br /> <br />SECTION 2. That the tabulation of votes cast in the Special <br />and General election held on May 7, 1994 for the purpose of <br />electing a Mayor, a city Council Member, Place Five, and a city <br />Council Member, Place Six, and submitting to the voters various <br />propositions including proposed amendments to the city Charter and <br />a proposal pertaining to the use of a proposed activity center on <br />park property made and certified to by the city Secretary of the <br />City of San Marcos, a copy of which is attached to and made a part <br />of this ordinance, is adopted as the official tabulation of the <br />votes cast at the election, and that the tabulation be filed and <br />recorded in the official records of the City of San Marcos as the <br />official canvass of the election. <br />
