CI:I -. .:..:I >- en - II. -:-i :;; ~ Q ~ - -.2:- "'Ii. c:.;¡~ ORDINANCE 1994- 32 \ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF THE SPECIAL AND GENERAL ELECTION HELD ON MAY 7, 1994 FOR THE PURPOSE, OF ELECTING A MAYOR, A CITY COUNCIL MEMBER, - PLACE FIVE, AND A CITY COUNCIL MEMBER, PLACE SIX AND SUBMITTING TO THE VOTERS VARIOUS PROPOSITIONS INCLUDING PROPOSED AMENDMENTS TO THE CITY CHARTER AND A PROPOSAL PERTAINING TO THE USE OF A PROPOSED ACTIVITY CENTER ON PARK PROPERTY; AND DECLARING AN EMERGENCY. RECITALS: ' 1. The city Council ordered that a Special and General election be held on May 7, 1994 for the purpose of electing a Mayor, a city Council Member, Place Five and a city Council Member, Place six and submitting to the voters various propositions including proposed amendments to the City Charter and a proposal pertaining to the use of a proposed activity center on park property. ~ 2. Notice of this election was duly published in the San Marcos Daily Record on April 10, 1994 and April 17, 1994. 3. Copies of this notice were duly posted at each city election precinct polling place prior to the election, and a copy of the notice was posted on the bulletin board at city Hall on April 12, 1994; and, 4. This election was duly and legally held on the 7th day of May, 1994, in conformity with the election laws of the State of Texas, and the results of the election have been certified and returned by the proper judges and clerks. . 5. The City Council of the City of San Marcos, Texas with the following members present: Kathy M. Morris, Billy G. Moore, Fred Guerra, Ron Hart and Bill Plummer -- and has today considered the returns of the Special and General election held on the 7th day of May, 1994. 6. It appears to the council, and the Council finds, that the election was in all respects lawfully held. 7. It appears to the Council, and the Council finds, that the tabulation of the results of the election is correct. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Special and General City election of May 7, 1994 was duly called, that notice of the election was given in accordance with law, and that the election was held in accordance with law. SECTION 2. That the tabulation of votes cast in the Special and General election held on May 7, 1994 for the purpose of electing a Mayor, a city Council Member, Place Five, and a city Council Member, Place Six, and submitting to the voters various propositions including proposed amendments to the city Charter and a proposal pertaining to the use of a proposed activity center on park property made and certified to by the city Secretary of the City of San Marcos, a copy of which is attached to and made a part of this ordinance, is adopted as the official tabulation of the votes cast at the election, and that the tabulation be filed and recorded in the official records of the City of San Marcos as the official canvass of the election.
