On April 5, 1994, the Zoning commission of the city of San <br /> Marcos held a public hearing regarding a request to change the <br /> zoning from "M" Single-Family, Duplex, Neighborhood Business <br /> District to "DP-2" Two-Family Dwelling District (Medium Density) for <br /> a 0.287 acre tract of property located at 607 Martin Luther King <br /> Drive. <br /> 2. Subsequent to the public hearing on that date, the Zoning <br /> Commission did, on April 5, 1994 consider the request and voted to <br /> approve and has recommended that the request be approved by the <br /> city council of the city. <br /> . <br /> 3. The city Council held a public hearing on the 23rd day <br /> of May , 1994, regarding the request. <br /> 4. All requirements of Appendix A, General Zoning Ordinance, <br /> of the Code of Ordinances of the city of San Marcos pertaining to <br /> amendments have been met. <br /> 5. The city Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the <br /> public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Official Zoning Map of the City, as <br /> described in section 3 of the General Zoning Ordinance, is hereby <br /> amended to rezone the following real property which is presently <br /> zoned "M" single-Family, Duplex, Neighborhood Business District to <br /> "DP-2" Two-Family Dwelling District(Medium Density): <br /> Street address: 607 Martin Luther King Drive. <br /> Size: 0.287 acre <br /> Leqal description: Lot 4, Block 4, D.S. Combs Addition, <br /> unit 1. <br /> Deed or plat reference: Volume 42, page 332, Hays County <br /> Deed Records. <br /> SECTION 2. That this Ordinance shall be in effect ten (10) <br /> days from and after its passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br /> following its passage, and provided that the Council did not vote <br /> to reconsider it. If reconsidered on June 13, 1994 it shall be <br /> in effect ten days from and after its passage on that date if <br /> approved. It shall not go into effect if denied. If not <br /> reconsidered and approved it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the <br /> city of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 23rd day of Hay , 1994, <br /> subject to reconsideration at the next regular City council meeting <br /> scheduled for June 13, 1994 . <br />
