<br /> ~ <br /> :s a- :>-0 ,- 123 <br /> Q~ <:> =~ <br /> 'g -=- F?,}q <br /> \11, <:> "'..... ~;a. <br /> U.è ~ u'~ <br /> ~~ §j !.J.J C;:) <br /> C,fj - <br /> ¡:::c <br /> -.2:- ORDINANCE 1994- 44 <br /> ~~ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br /> ZONING MAP OF THE CITY BY REZONING 17.74 ACRES <br /> TRACT OF PROPERTY, LOCATED IN THE 1200 BLOCK <br /> OF WONDER WORLD DRIVE FROM "LB" LIMITED <br /> BUSINESS DISTRICT AND "c" COMMERCIAL DISTRICT <br /> TO "MF-5" MULTI-FAMILY DISTRICT (HIGH DENSITY) <br /> AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> L On April 5, 1994, the Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the <br /> zoning from "LB" Limited Business District and "clt Commercial <br /> District to "MF-5" Multi-Family District (High Density) for 17.74 <br /> acres of property located in the 1200 Block of Wonder World Drive. <br /> 2. Subsequent to the public hearing on that date, the Zoning <br /> Commission did, on April 5, 1994 consider the request and voted to <br /> approve and has recommended that the request be approved by the <br /> City Council of the city. <br /> 3. The city Council held a public hearing on. the 13t:h day <br /> of ,Tune , 1994, regarding the request. <br /> 4. All requirements of Appendix A, General Zoning ordinance, <br /> of the Code of ordinances of the city of San Marcos pertaining to <br /> amendments have been met. <br /> 5. The City Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the <br /> public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION L That the Official Zoning Map of the city, as <br /> described in section 3 of the General Zoning Ordinance, is hereby <br /> amended to rezone the following real property, part of which is <br /> presently zoned "LB" Limited Business District and the remainder of <br /> which is presently zoned "c" Commercial District, to "MF-5" Multi- <br /> Family District (High Density): <br /> Street address: 1200 Block of Wonder World Drive. <br /> Size: 17.74 acres <br /> Leqal description: See attached Exhibit A. <br /> <br /> Deed or plat reference: Volume 263, page 522, Hays <br /> County Deed Records. <br /> SECTION 2. That this Ordinance shall be in effect ten (10) <br /> days from and after its passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br /> following its passage, and provided that the Council did not vote <br /> to reconsider it. If reconsidered on June 27, 1994 it shall be <br /> in effect ten days from and after its passage on that date if <br /> approved. It shall not go into effect if denied. If not <br /> reconsidered and approved it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the <br /> City of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 13th day of June , 1994, <br /> subject to reconsideration at the next regular city Council meeting <br /> scheduled for June 27, 1994 . <br /> Reconsidered yes no X <br />
