<br /> I Jç 11 <br /> city manager is further authorized to terminate stage 4 <br /> (aquifer risk) based upon an appropriate change in the <br /> water level of the index well. The order to implement and <br /> to terminate stage 4 (aquifer risk) shall be made by public <br /> announcement and shall be published a minimum of one (1) <br /> time in a newspaper of general circulation in the city. <br /> SECTION 5. That the amended San Marcos Water Conservation <br /> Plan, a copy of which is attached to this ordinance, is approved <br /> and adopted. <br /> SECTION 6. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaining <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 7. That all ordinances and resolutions or parts of <br /> ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 8. That any person violating any provision of this <br /> ordinance shall be deemed guilty of a misdemeanor and upon <br /> conviction shall be subject to the penalty provided in section 1-5 <br /> of the San Marcos Code of Ordinances. <br /> SECTION 9. That the importance of this Ordinance creates an <br /> emergency and an imperative public necessity so that the provisions <br /> of the Charter requiring that ordinances shall be presented at <br /> three separate meetings and that no ordinance shall become <br /> effective until the expiration of ten (10) days following the date <br /> of its final passage be suspended, and these provisions are hereby <br /> suspended, and this ordinance shall take effect and be in full <br /> force and effect from and after its adoption and after its <br /> publication in a newspaper of general circulation within the city <br /> as provided by the city Charter of the City of San Marcos. <br /> PASSED, APPROVED AND ADOPTED this 13th lr C~<' 1994. <br /> F ed Guerra <br /> Mayor Pro-Tem <br /> Atwst:, ~ <br /> oJY WY1U4V P,.udJ <br /> JanlS K.
