That Article VI of Chapter 2 of the San Marcos Code of <br />Ordinances is amended to read as follows: ~ <br /> <br />ARTICLE VI. CITY PLANNING AND ZONING COMMISSION <br /> <br />Sec. 2-113. Membership; Eligibili tv for Appointment; Term of <br />Office. <br /> <br />(a) The planning and zoning commission will consist, of nine <br />members. <br /> <br />(b) All of the commission members except for one will be <br />residents of and own real property, in the city. The remaining <br />- member will be a resident of and own property within the <br />extraterritorial jurisdiction of the city. <br /> <br />(c) The council will seek to ensure broad representation and <br />expertise in making appointments to the planning and zoning <br />commlSSlon. <br /> <br />(d) Members of the planning and zoning commission will be <br />appointed for staggered three year terms, with one-third to be <br />appointed each year on a continuing basis. <br /> <br />Sec. 2-114. References to Separate Commissions. <br /> <br />All references in this Code or its Appendices to the "planning <br />commission" or the "zoning commission" will be deemed to mean the <br />planning and zoning commission. <br /> <br />Sec. 2-115 - 2-124. Reserved. <br /> <br /> <br />SECTION 2. (a) The City Council will appoint all members of the <br />combined planning and zoning commission at its first regular <br />I meeting in October, 1994. When all of its members take office, the <br />I commission will succeed the separate planning commission and zoning <br />\ commlSSlon. <br /> <br />(b) The separate planning commission and zoning commission <br />will continue in existence until they are succeeded by the combined <br />planning and zoning commission, and all acts of the separate <br />planning commission and zoning commission up to that time in <br />matters subject to the jurisdiction of each commission are <br />validated. <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />
