;:E ~ -:.>.=~ 09:,1 g: ;;: ~ l5l ill 5 -: J:j~ _<J ~ C!::: e ~Q ~ ôð5 -~ = CZ>15,' ORDINANCE 1994- c;o w-=1 ~ ~~ ë <:sa AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 26.67 ACRES, MORE OR LESS, FRONTING ON THE SOUTHWEST RIGHT-OF-WAY LINE OF THE 1200 BLOCK OF CENTER POINT ROAD IN HAYS COUNTY, TEXAS (LOWMAN RANCH PROPERTY), THIS LAND BEING LOCATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY AND ADJACENT TO PRESENT CITY BOUNDARIES; APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR ! PUBLICATION AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two (2) public hearings, held 'once on Apri 1 25, 1994 ,and once on May 2, 1994 , to consider the proposed annexation by the City of San Marcos, Texas of 26.67 acres, more or less, of land owned by Lowman Ranch, Ltd. fronting on the southwest right-of-way line of the 1200 Block of Center Point Road, Hays County, Texas, described by metes and bounds in attached Exhibit A (the "Annexation Area"). 2. An on-site public hearing has not been requested in writing by more than 20 adults residing in the Annexation Area. 3. Notices of these public hearings were published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on April 10, 1994 and April 17, 1994 ,these dates being not more than twenty (20) days nor less than ten (10) days prior to the hearings for which notices were given. 4. Prior to the publication of notices of these hearings, the City Council of the City of San Marcos, Texas directed preparation of a service plan that provides for the extension of municipal services to the Annexation Area. 5. The proposed service plan was made available for inspection and explained to the inhabitants of the Annexation Area at the public hearings. 6. The Annexation Area is contiguous and adj acent to the current boundaries of the City of San Marcos, Texas. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Annexation Area is hereby annexed to the City of San Marcos, Texas. SECTION 2. That the Service Plan for the Annexation Area, a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, is approved. SECTION 3. That the corporate limits of the City are extended to include the Annexation Area. SECTION 4. That the Annexation Area is a part of the City of San Marcos, Texas, and any residents in it are entitled to all the rights and privileges of all citizens of the City, and are bound by the acts, ordinances, resolutions and regulations of the City. SECTION 5. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
