<br /> 156 <br /> RESOLUTION 1994- 105 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br /> OF A LICENSE AGREEMENT BETWEEN THE CITY AND <br /> SOUTHWEST TEXAS STATE UNIVERSITY FOR THE <br /> CONSTRUCTION AND MAINTENANCE OF DRAINAGE <br /> IMPROVEMENTS ADJACENT TO SESSOM DRIVE; AUTHORIZING <br /> THE CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF <br /> OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS <br /> 1. The city is the owner of the street right-of-way in the <br /> 300 block of Sessom Drive in San Marcos, Hays County, Texas. <br /> 2. Southwest Texas State University (SWTSU) owns property <br /> adjacent to the 300 Block of Sessom Drive upon which its Physical <br /> Plant facility is located. <br /> 3. A leakage of gasoline into the Sessom Drive right-of-way <br /> has recently occurred, apparently originating in fuel storage and <br /> pumping equipment located within SWTSU's Physical flant facility. <br /> 4. SWTSU has begun work to contain and remediate the fuel <br /> leak, some of which is occurring within the Sessom Drive right-of- <br /> way. <br /> 5. This License is for the purpose of the city granting <br /> permission to SWTSU to use an area of the Sessom Drive right-of-way <br /> for its remediation activities. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the License <br /> Agreement attached to this Resolution between the city and SWTSU <br /> for construction and maintenance of drainage improvements adjacent <br /> to Sessom Drive are approved. <br /> PART 2. That the city Manager, Larry D. Gilley, is authorized <br /> to execute this Agreement on behalf of the city. <br /> PART 3.
