<br /> /f'7P <br /> -3- <br /> indemnify and defend the city and its officers, <br /> agents and employees from and against all <br /> liability, claims, damages, expenses, attorney's <br /> fees, and costs for injuries to and 'deaths of <br /> -- including employees of the Licensee, and <br /> persons <br /> damages to any property growing out of, incident <br /> to, or in any manner resulting from the Fuel Leak <br /> or the construction, maintenance or use of the <br /> Improvements, to the fullest extent allowed by law. <br /> 4. Termination: <br /> (a) If the Licensee fails to perform any of its <br /> obligations, the City may terminate this agreement <br /> ~ <br /> by giving to the Licensee not less than thirty (30) <br /> days' advance written notice of its intention to do <br /> so. <br /> (b) Either the City or the Licensee may terminate this <br /> agreement at any time by giving to the other party <br /> ( <br /> I not less than ninety (9 0) days' advance written <br /> ¡ <br /> - <br /> notice of its intention to do so. <br /> (c) The Licensee agrees to restore the License Area to <br /> its condition as it existed prior to the making of <br /> the Improvements, insofar as practicable, promptly <br /> upon its issuance to the City, or its receipt from <br /> the City, of any notice to terminate this <br /> Agreement. <br /> (d) The Licensee's obligations under section 3(c) above <br />
