<br /> , <br /> AMENDED <br /> INTERLOCAL AGREEMENT <br /> RELATED TO SCHOOL CONSTRUCTION <br /> STATE" OF TEXAS <br /> COUNTY OF HAYS <br /> SECTION 1. PARTIES. This agreement is between the city of San <br /> Marcos, a Texas municipal corporation (the" ci ty") and the San <br /> Marcos Consolidated Independent School District, a political <br /> subdivision of the State of Texas (" SMCISDII). <br /> SECTION 2. RECITALS. <br /> 2.1 SMCISD is in the process of developing an intermediate school <br /> (the "Intermediate School") on a 26.36 acre tract of property (the <br /> "Intermediate School Propertyll) at the intersection of Hunter Road <br /> and stagecoach Drive in San Marcos, Texas. <br /> 2.2 SMCISD has requested, and the city's Planning commission has <br /> agreed to grant, a variance to the city ordinance which requires <br /> the final plat of a subdivision to be filed in county plat records <br /> before a building permit can be issued for construction within the <br /> Intermediate School Property. ~ <br /> 2.3 The variance granted by the Planning Commission is expressly <br /> conditioned on SMCISD's execution and faithful performance of this <br /> agreement. <br /> 2.4 SMCISD is also in the process of developing a junior high <br /> school (the "Junior High Schooll1) on a 28.37 acre tract of property <br /> (the "Junior High School Property") near the intersection of the <br /> new Foxtail Run and Hunter Road in San Marcos, Texas. <br /> SECTION 3. SMCISD OBLIGATIONS. <br /> 3.1 SMCISD has platted the Intermediate School Property, and is in <br /> the process of constructing the Intermediate School, and all road <br /> and utility improvements associated with that school (the <br /> "Intermediate School Improvementsll). SMCISD is beginning the <br /> process of constructing the Junior High School, and all road and <br /> utility improvements associated with that school (the "Junior High <br /> School Improvementsll) , and has obtained the city's approval of <br /> SMCISD's construction plans for those improvements. SMCISD agrees <br /> to complete the process of platting the Junior High School <br /> Property. <br /> 3.2 SMCISD agrees to apply for and obtain all building permits <br /> from the city required for construction of the Intermediate School <br /> and the Junior High School in full compliance with city building <br /> and fire safety codes. <br />
