- ('5'1 ø -3- SECTION 4. CITY OBLIGATIONS. 4.1 The city agrees to issue, after appropriate review, building permits for the construction of the Junior High School upon recording of the final plat of the subdivision of the Junior High School Property. - ~ 4.2 The city agrees to provide reasonable expediting of all of its review and inspection processes related to construction for the Intermediate School and Junior High School, the platting of the Intermediate School Property and the Junior High School Property, and the construction of the Intermediate School Improvements and the Junior High School Improvements. SECTION 5. MISCELLANEOUS. 5.1 Except as expressly provided herein, this agreement does not supersede the application of any city ordinances relating to the construction of the Intermediate School or the Junior High School, the platting of the Intermediate School Property or the Junior High School Property, and the construction of the Intermediate School Improvements or the Junior High School Improvements. ~ 5.2 This agreement may be modified or amended only by a duly authorized written amendment executed by both parties. 5.3 This agreement may not be assigned by SMCISD or the city. 5.4 This agreement is subject to, and governed by, the laws of the State of Texas and the ordinances of the city.
