ORDINANCE 1994- 53 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING A TRACT OF <br />PROPERTY 2.0 ACRES IN SIZE, MORE OR LESS, <br />LOCATED IN THE 1400 BLOCK OF RIVER ROAD FROM <br />"PD" PRE-DEVELOPMENT DISTRICT TO "MF-2" MULTI-, <br />FAMILY DISTRICT (MEDIUM DENSITY) AND DECLARING <br />'- AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On May 31, 1994, the Zoning commission of the city of San <br />Marcos held a public hearing regarding a request to change the <br />zoning from "PD" Pre-Development District to "MF-2" Multi-Family <br />District (Medium Density) for a tract of property 2.0 acres in <br />size, more or less, located in the 1400 Block of River Road. <br /> <br />2. Subsequent to the public hearing on that date, the Zoning <br />Commission did, on May 31, 1994 consider the request and voted to <br />approve and has recommended that the request be approved by the <br />City Council of the City. <br /> <br />3. The city Council held a public hearing on. the 25th day <br />of July , 1994/ regarding the request. <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, <br />of the Code of Ordinances of the City of San Marcos pertaining to <br />amendments have been met. <br /> <br />5. The city Council hereby finds and determines that the <br />adoption of the following ordinance is in the interest of the <br />public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official Zoning Map of the city, as <br />described in Section 3 of the General Zoning Ordinance, is hereby <br />amended to rezone the following real property which is presently <br />zoned "PD" Pre-Development District to "MF-2" Multi-Family <br />District (Medium Density): <br /> <br />street address: 1400 Block of River Road. <br /> <br />Size: 2.0 acres, more or less. <br /> <br />Legal description: See attached Exhibit A. <br /> <br />Deed or plat reference: Volume 727/ Page 472, Hays County <br />Deed Records. <br /> <br />SECTION 3. That this Ordinance shall be in effect ten (10) <br />days from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting <br />following its passage, and provided that the Council did not vote <br />to reconsider it. If reconsidered on August 8, 1994 it shall be <br />in effect ten days from and after its passage on that date if <br />approved. It shall not go into effect if denied. If not <br />reconsidered and approved it shall be published in a newspaper of <br />-- general circulation in the area as required by the Charter of the <br />city of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this 25th day of July, 1994, <br />subject to reconsideration at the next regular City Council meeting <br />scheduled for August 8, 1994 . <br /> <br />Reconsidered yes no X <br /> <br />If yes approved <br />
