' ORDINANCE 1994- 54 <br /> - <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br /> ZONING MAP OF THE CITY BY REZONING A TRACT OF <br /> PROPERTY 1.0.05 ACRES IN SIZE, MORE OR LESS, <br /> LOCATED AT 426 BROADWAY DRIVE FROM "R-1" <br /> SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY), <br /> TO "MF-211 MULTI-FAMILY DISTRICT (MEDIUM <br />.- DENSITY) AND DECLARING AN EFFECTIVE DATE. <br />1 <br />¡ RECITALS: <br /> 1. On May 31, 1994, the Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the <br /> zoning from IIR-1" Single-Family Dwelling District (Low Density) to <br /> "MF-211 Multi-Family District (Medium Density) for a tract of <br /> property 10.05 acres in size, more or less, located at 426 Broadway <br /> Drive. <br /> 2. Subsequent to the public hearing on that date, the Zoning <br /> Commission did, on May 31, 1994 consider the request and voted to <br /> approve and has recommended that the request be approved by the <br /> City Council of the city. <br /> . <br /> 3. The City Council held a public hearing on the 25th day <br /> of July , 1.994/ regarding the request. <br /> 4. All requirements of Appendix A, General Zoning Ordinance, <br /> of the Code of Ordinances of the City of San Marcos pertaining to <br /> amendments have been met. <br /> 5. The City Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the <br /> public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Official Zoning Map of the city, as <br /> described in Section 3 of the General Zoning Ordinance, is hereby <br /> amended to rezone the following real property which is presently <br /> zoned "R-1.11 Single-Family Dwelling District (Low Density) to "MF-2" <br /> Multi-Family District (Medium Density): <br /> Street address: 426 Broadway Drive. <br /> <br /> Size: 10.05 acres, more or less. <br /> Legal description: See attached Exhibit A. <br /> Deed .or plat reference: Volume 240/ page 17, Hays County <br /> Deed Records. <br /> SECTION 3. That this Ordinance shall be in effect ten (1.0) <br /> days from and after its passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br />i following its passage, and provided that the Council did not vote <br />! to reconsider it. If reconsidered on August 8, 1994 it shall be <br />f in effect ten days from and after its passage on that date if <br /> approved. It shall not go into effect if denied. If not <br /> reconsidered and approved it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the <br /> city of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 25th day of July , 1994, <br /> subject to reconsideration at the next regular City Council meeting <br /> scheduled for August 8, 1994 . <br /> Reconsidered yes no X <br />
