<br />~ <br />r ~ ~ >- ~ "Î n J"""} <br />c~ ~ ~~ rlV <br />flJ..8 - w~ <br />, , . -Q ~ :r c:: <br />¡~ O, .---; &3 ãS <br />;-'-~ ' ':1':)- <br />iLÇ} =5 ~~ ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS <br />AUTHORIZING THE ISSUANCE AND SALE OF CITY OF SAN MARCOS <br />GENERAL OBLIGATION BONDS, SERIES 1994, INTHEAGGREGATE PRINCIPAL <br />AMOUNT OF $5,300,000; PRESCRIBING THE FORM OF SAID BONDS; LEVYING <br />AN ANNUAL AD VALOREM TAX TO PAY SAID BONDS; AWARDING THE SALE <br />THEREOF; APPROVING THE OFFICIAL STATEMENT; ENACTING OTHER <br />PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY <br /> <br /> <br />WHEREAS, by virtue of an election held within the City of San Marcos, Texas (the" City") on <br />-, May 7, 1994, this City Council (the "City Council") became authorized to issue, sell and deliver <br />$5,300,000 bonds (the "Bonds") of said City, and this City Council finds and determines that it is <br />necessary and proper to order the issuance, sale and delivery of all of such voted bonds; <br /> <br />WHEREAS, the Bonds hereinafter ordered to be issued were voted and are to be issued, sold and <br />delivered pursuant to the Constitution and laws of the State of Texas, including particularly Tex. Rev. <br />Civ. Stat. Ann art. 1175, as amended; <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS: <br /> <br />ARTICLE I <br />. <br />DEFINITIONS AND OTHER PRELIMINARY MATTERS <br /> <br />Section 1.01. Definitions. <br /> <br />Unless otherwise expressly provided or unless the context clearly requires otherwise, in this <br />Ordinance the following terms shall have the meanings specified below: <br /> <br />"Bond" means any of the Bonds. <br /> <br />"Bonds" means the City's bonds entitled "City of San Marcos General Obligation Bonds, Series <br />1994" authorized to be issued by Section 3,01 of this Ordinance. <br /> <br />"Closing Date" means the date of the initial delivery of and payment for the Bonds. <br /> <br />"Code" means the Internal Revenue Code of 1986, as amended, including applicable regulations, <br />published rulings and court decisions relating thereto. <br /> <br />"Construction Fund" means the construction fund established by Section 8.01(a) of this Ordinance. <br /> <br />"Designated Payment/Transfer Office" means (i) with respect to the initial Paying Agent/Registrar <br />named herein, its corporate trust office in Dallas, Texas, and (ii) with respect to any successor Paying <br />Agent/Registrar, the office of such successor designated and located as may be agreed upon by the City <br />and such successor. <br /> <br /> <br /> <br /> <br /> <br /> <br />SANMAR\GOI'4'.DOCS",O RD SCE.
