Weather conditions permitting, City shall complete the initial operations for the <br />installation of the wastewater pipeline and within one-hundred fifty feet (150') of <br />the residence within 20 consecutive working days, and all initial operations on the <br />subject property within 30 consecutive working days. It is understood and agreed <br />that the initial installation referenced herein shall include: <br /> <br />a. Installation of the wastewater pipe; <br />b. Installation of manholes; <br />c. Manhole coating, fittings installation, etc.; and <br />d. Backfill of any trenches and excavations. <br /> <br />It is further understood and agreed that the initial installation described herein <br />does not include secondary operations including: <br /> <br />e. Surface restoration;. <br /> <br />7. Weather conditions permitting, secondary operations as described above within <br /> one-hundred fifty feet (150') of the residence shall be completed in 10 <br /> consecutive working days; <br /> <br />It is understood and agreed that pre-construction operations to clear the <br />Permanent Easement shall be completed within 5 consecutive working days, <br />including, but not limited to removal trees and the following improvements: a <br />smoke house; and a concrete slab as illustrated on the attached plat; <br /> <br />It is understood and agreed that certain construction related operations are not <br />described in the initial and secondary phases above. These non-intrusive <br />operations, including, but not limited to system testing, site review, silt fence <br />removal and similar operations that do not include site excavation may be <br />conducted outside of the time frames described above. <br /> <br />10. It is understood between Grantor and City that a minimum of thirty days is <br /> required between the initial and final work phases to allow for testing of the <br /> system, and that the final work phase will not commence until the system has <br /> concluded the testing phase. Further, that in the event of the failure during testing <br /> of any portion of the system as intially installed the City shall have the full <br /> opportunity to repair the affected section without penalty, provided said repairs <br /> are completed within 5 consecutive working days; <br /> <br />11. The City shall pay Grantor as damages the amount of $300.00 for each day <br /> primary and secondary construction exceeds the number of days permitted herein <br /> as described above. The City shall provide Grantor a detail accounting of any <br /> time allowances made due to interruptions caused by weather. Lost construction <br /> days due to weather (and conditions caused by weather, i.e. flooded or muddy <br /> construction area, etc.) shall not count against the City; <br /> <br /> <br />
