Q~; ORDINANCE 1994- 62 <br />-. -~ - <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING A TRACT OF <br />PROPERTY 10.447 ACRES IN SIZE, MORE OR LESS, <br />LOCATED AT 1606 IH 35 NORTH FROM" C" <br />COMMERCIAL DISTRICT TO "MF-5" MULTI-FAMILY, <br />DISTRICT (HIGH DENSITY) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On June 28,1994, the Zoning commission of the City of San <br />Marcos held a public hearing regarding a request to change the <br />zoning from "C" Commercial District to "MF-5" Multi-Family District <br />(High Density) for a tract of property 10.447 acres in size, more <br />or less, located at 1606 IH 35 North. <br /> <br />2. Subsequent to the public hearing on that date, the zoning <br />commission did, on June 28, 1994 consider the request and voted to <br />approve and has recommended that the request be approved by the <br />city council of the city. <br /> <br />3. The city council held a public hearing OTh the 8th day <br />of August, 1994, regarding the request. <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, <br />of the Code of Ordinances of the city of San Marcos pertaining to <br />amendments have been met. <br /> <br />5. The city Council finds and determines that the adoption of <br />the following ordinance is in the interest of the public health, <br />morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official zoning Map of the city, as <br />described in section 3 of the General Zoning Ordinance, is amended <br />to rezone the following real property which is presently zoned "C" <br />Commercial District to "MF-5" Multi-Family District (High <br />Density) : <br /> <br />Street address: 1606 IH 35 North. <br /> <br />Size: 10.447 acres, more or less. <br /> <br />Legal description: Lot 1, section 1 and Lot 1, section <br />2, Interpark East Subdivision <br /> <br />Deed or plat reference: Volume 2, Page 248 and Volume 2, <br />page 305, Hays County Plat Records. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) <br />days from and after its passage and after it has been subject to <br />reconsideration by the council at its next regular meeting <br />following its passage, and provided that the Council did not vote <br />to reconsider it. If reconsidered on August 22, 1994 it shall be <br />in effect ten days from and after its passage on that date if <br />approved. It shall not go into effect if denied. If not <br />reconsidered and approved it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the <br />city of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this 8th day of August, 1994, <br />subject to reconsideration at the next regular city Council meeting <br />scheduled for August 22, 1994 . <br />
