<br />-- ~ -=:J- >~. <br />. cr- c:: l:S <br />Q~ g: ~~ 50 <br />i3J ~ '-. ~ = <br />U -0 .::J ~a5 <br /> <br />W~ =5 ~; ORDINANCE 1994- 66 <br />L;{ ES <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 5-3 OF CHAPTER 5, <br />BUILDING CONSTRUCTION AND RELATED ACTIVITIES, OF <br />THE SAN MARCOS CODE OF ORDINANCES TO REVISE SECTION <br />3208 OF THE STANDARD BUILDING CODE REGARDING THE <br />USE OF WOOD SHINGLES AND SHAKES AS ROOFING <br />MATERIALS; PROVIDING FOR SEVERABILITY; REPEALING <br />ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; <br />-- PROVIDING FOR PUBLICATION AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Section 3208 of the Standard Building Code, as amended in <br />section 5-3 of the San Marcos Code of Ordinances, prohibits the use <br />of wood shingles and shakes as new or replacement roofing <br />materials. <br /> <br />2. The Construction Board of Adjustments and Appeals has <br />recommended that Section 3208 be amended to allow the use of wood <br />shingles and shakes as replacement roofing for existing buildings <br />that now have these roofing materials. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY .OF SAN MARCOS I <br />TEXAS: <br /> <br />SECTION 1. That the amendment to Section 3208 of the Standard <br />Building Code contained in section 5-3 of the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />3208 is amended to read as follows: <br /> <br />3208 Wood Shingles and Shakes. <br /> <br />Wood shingles and shakes. are prohibited as new or <br />replacement roofing material except that wood shingles and <br />shakes as the primary roofing surface in existence on June <br />1, 1994, may be replaced with U.L. Listed, Fire Retardant <br />shingles or shakes as per Table 3208.1, and Section 3208.5, <br />Standard Building Code, 1991 edition. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 4. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in section 1-5 <br />of the San Marcos Code of Ordinances. <br /> <br />SECTION 5.
