The City Council has reviewed evidence, including the <br />statistics generated by the city of San Marcos Police Department on <br />the attached Exhibit A, and has determined that there has been an <br />increase in juvenile gang related activity and an increase in crime <br />involving persons under the age of seventeen in the city of San <br />Marcos. <br /> <br />2. The city Council believes that persons under the age of <br />seventeen are particularly susceptible to unlawful é.nd gang related <br />activities and to be victims of older perpetrators of crime. <br /> <br />3. The City of San Marcos has a compelling interest in providing <br />for the protection of minors from each other and from other <br />persons, the enforcement of parental control of and responsibility <br />for their children, the protection of the general public, and the <br />reduction of the incidence of juvenile involvement in criminal <br />activities. <br /> <br />4. The City Council believes that a curfew for persons under <br />seventeen years of age will be i~ the interest of the public <br />health, safety, and general welfare, and will help to attain the <br />foregoing objectives. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Chapter 16, Miscellaneous Offenses and <br />provisions, of the San Marcos Code of Ordinances is amended by <br />adding an Article VII to read as follows: <br /> <br />ARTICLE VII. CURFEW FOR MINORS <br /> <br />Sec. 16-80. Definitions: Curfew Hours for Minors. <br /> <br />In this Article: <br /> <br />(1) Chief of police means the chief of police of the <br />city of San Marcos or a designated representative. <br /> <br />(2) Curfew hours means: <br /> <br />(A) 11:00 p.m. until midnight on any Sunday, <br />Monday, Tuesday, Wednesday, or Thursday; and, <br /> <br />(B) Midnight until 6:00 a.m. on any day; and, <br /> <br />(C) 9:00 a.m. until 2:30 p.m. on any Monday, <br />Tuesday, Wednesday, Thursday or Friday. <br /> <br />(3) Direct route means the shortest path of travel <br />through a public place to reach a final destination <br />without any detour or stop along the way. <br />
