<br /> /gZ,c' <br /> -4- <br /> (3) the minor's school was not in session. <br /> Sec. 16-83. Enforcement. <br /> (a) A peace officer, upon finding a minor in violation <br /> of section 16-81(a), will: <br /> (1) ascertain the name and address of the minor; <br /> (2) have the authority to issue a citation to the <br /> minor; and <br /> (3) order the minor to go promptly home by a <br /> direct route. <br /> (b) A peace officer, upon finding a minor in violation <br /> of section 16-81 (a), may take the minor into <br /> custody and deliver the minor to a juvenile <br /> processing office if reasonable grounds exist to <br /> believe the minor has engaged in delinquent conduct <br /> or conduct indicating a need for supervision as <br /> described in Section 51. 03 of the Texas Family <br /> Code, as amended. ~ <br /> (c) The parents of a minor may be cited for violation <br /> of 16-81(b) upon the minor receiving a second <br /> citation for violation of Section 16-81(a). <br /> Sec. 16-84. Referral to Juvenile Authorities. <br /> Any minor who violates Section 16-81(a) is subject to the <br /> penalty provided in Section 1-5 of this Code, and is also <br /> subject to referral to juvenile authorities under Title 3 of <br /> the Texas Family Code, as amended. <br /> SECTION 2. That for the first 30 days after this ordinance <br />goes into effect all citations issued shall be warnings. <br /> SECTION 3. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> SECTION 4. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 5. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in section 1-5 <br />of the San Marcos Code of Ordinances. <br /> SECTION 6. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published ln a <br />newspaper of gener.al circulation in the area as required by the <br />Charter of the city of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading July 25, 1994. <br /> PASSED AND APPROVED on second reading August 8, 1994. <br /> PASSED, APPROVED AND ADOPTED t 22, 1994. m,~ <br /> Kath <br /> .
