<br />-::::t-- <br />.~, ~ ~ 9 0 <br />Q~ cr- <~¡ <br />~ ~ tr~ <br />fJ1~ .;-- 0:::. , <br />-I-o N ~~i <br />-rJ c:; ~ 'S' <br />U-':.;, :2 ~~ <br />~. ~Q ORDINANCE 1994- ~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING A TRACT OF <br />PROPERTY 0.1 ACRE IN SIZE, MORE OR LESS, <br />LOCATED AT 215 JACKMAN STREET FROM "M" SINGLE- <br />FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS, <br />DISTRICT TO "R-2" SINGLE-FAMILY DWELLING <br />DISTRICT (MEDIUM DENSITY) AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On August 2, 1994, the zoning Commission of the city of <br />San Marcos held a public hearing regarding a request to change the <br />zoning from "M" single-Family, Duplex and Neighborhood Business <br />District to "R-2" single-Family Dwelling District (Medium Density) <br />for a tract of property 0.1 acre in size, more or less, located at <br />215 Jackman Street. <br /> <br />2. Subsequent to the public hearing on that date, the zoning <br />commission did, on August 2, 1994, consider the request and voted <br />to approve and has recommended that the request be approved by the <br />city Council of the City. ~ <br /> <br />3. The city Council held a public hearing on the 12th day <br />of September, 1994, regarding the request. <br /> <br />4. All requirements of Appendix A, General Zoning Ordinance, <br />of the Code of Ordinances of the City of San Marcos pertaining to <br />amendments have been met. <br /> <br />5. The city Council finds and determines that the adoption of <br />the following ordinance is in the interest of the public health, <br />morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Official zoning Map of the city, as <br />described in section 3 of the General zoning Ordinance, is amended <br />to rezone the following real property which is presently zoned "Mil <br />Single-Family, Duplex and Neighborhood Business District to "R-2" <br />Single-Family Dwelling District (Medium Density): <br /> <br />Street address: 215 Jackman Street. <br /> <br />size: 0.1 acres, more or less. <br /> <br />Leqal description: See attached Exhibit A. <br /> <br />Deed or plat reference: Volume 685, Page 669, Hays County <br />Deed Records. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (10) <br />days from and after its passage and after it has been subject to <br />reconsideration by the Council at its next regular meeting <br />following its passage, and provided that the Council did not vote <br />to reconsider it. If reconsidered on September 26, 199~ shall be <br />in effect ten days from and after its passage on that date if <br />approved. It shall not go into effect if denied. If not <br />reconsidered and approved it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the <br />City of San Marcos, Texas. <br /> <br />PASSED, APPROVED AND ADOPTED this12th day of September, 1994, <br />subject to reconsideration at the next regular city Council meeting <br />scheduled for September 26, 1994. <br />
