<br />r <br /> <br />~ ~ ~~"f 92 <br />'A:Q.J C- <:: í <br />1.-1 -" ....' <br />W g - i¿d:::s! <br />.J 'b ~ ~~ ORDINANCE 1.994 - 7l <br />-°1 c "'õ <br />LL. -¡ :2 ¡:: b AN ORDINANCE OF THE CITY COUNCIL OF THE <br /><: Q~ CITY OF SAN MARCOS, TEXAS, AMENDING <br />EXHIBITS A AND B TO SECTIONS 30-27 AND <br />30-35, RESPECTIVELY, OF THE SAN MARCOS <br />CODE OF ORDINANCES TO INCREASE WATER AND <br />SEWER RATES AND, FOR A PORTION OF EACH <br />CALENDAR YEAR, TO INSTITUTE A SCALED <br />MINIMUM BILL BASED UPON METER SIZE AND AN <br />INVERTED RATE STRUCTURE IN THE CITY'S <br />~- WATER AND SEWER RATE SCHEDULES¡ PROVIDING <br />FOR SEVERABILITY¡ REPEALING ALL <br />CONFLICTING ORDINANCES ¡ PROVIDING FOR <br />PUBLICATION AND DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Exhibit A to Section 30-27 of the San <br />Marcos Code' of Ordinances, is amended to read as shown on the <br />Exhibit A which is attached and made a part of this ordinance <br />for all purposes. <br /> <br />SECTION 2. That Exhibit B to Section 30-35 of the San <br />Marcos Code of Ordinances is amended to read as shown on the <br />Exhibit B which is attached to and made a part of this <br />ordinance for all purposes. ~ <br /> <br />SECTION 3. It is hereby declared to be the intention of <br />the City Council that the sections, paragraphs, sentences, <br />clauses and phrases of this Ordinance are severable, and if <br />any phrase, clause, sentence, paragraph or section of this <br />Ordinance shall be declared unconstitutional by the valid <br />judgment or decree of any court of competent jurisdiction, <br />such unconstitutionality shall not affect any of the <br />remaining phrases, clauses, sentences, paragraphs and <br />sections of this Ordinance, since the same would have been <br />enacted by the City Council without the incorporation in this <br />Ordinance of any such unconstitutional phrase, clause, <br />sentence, paragraph or section. <br /> <br />SECTION 4. That all ordinances or parts of ordinances <br />in conflict with this ordinance are hereby repealed. <br /> <br />SECTION 5. That this Ordinance shall be in effect for <br />all billings mailed on and after October 1, 1994. <br /> <br />SECTION 6. That the importance of this Ordinance <br />creates an emergency and an imperative public necessity so <br />that the provisions of the Charter requiring that ordinances <br />shall be presented at three separate meetings and that no <br />ordinance shall become effective until the expiration of ten <br />(10) days following the date of its final passage be <br />suspended, and these provisions are hereby suspended, and <br />this Ordinance shall take effect and be in full force and <br />effect from and after its adoption and after its publication <br />in a newspaper of general circulation within the City as <br />provided by the City Charter of the City of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 12th day of <br />- September, 1994, ~' v"Vl. ifì~ <br /> <br />:~ Morris <br /> <br />Mayor <br /> <br /> <br /> <br />&~~ <br /> <br />Approved: ~~fs K. womac~/ßr <br />~ß~~ City Secretary <br /> <br />Mark B.
