The McAllister Addition appears of record in the Deed Records <br />of Hays County, Texas, in Book Z at page 323. <br /> <br />2. The plat of this addition shows an alley, located between Lot <br />3, Block 1 and Lot 4 of Block 2 of the Addition. <br /> <br />3. The City of San Marcos has been requested by Michael Scanio, <br />Denny Arceneaux and Elizabeth Arceneaux to abandon this alley. <br /> <br />4. The City of San Marcos has determined that it is in the <br />public interest to abandon this alley to the abutting property <br />owners. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the Alleyway between Lot 3, Block 1 and Lot <br />4, Block 2 of the McAllister Addition to the City of San Marcos, <br />per the plat recorded in Volume Z, page 323, Deed Records of Hays <br />County, Texas is vacated and abandoned as to any use, right, claim <br />in, or responsibility for the upkeep and maintenance by the public <br />in general and the City of San Marcos in particular. <br /> <br />SECTION 2. That upon payment to the City of the fair market <br />value of the property, the City Manager is authorized to execute <br />Quitclaim Deeds to the abutting property owners. <br /> <br />SECTION 3.
