<br />Q~ ~ ~! 97 <br />~1J ~ - tJj <br />1lt.l<;5 ('\j 0:::<;;. <br />~;Ìi 0 ßQ5 <br />ü:~ ~ ~; <br />~ (.j c.;) <br />ORDINANCE 1994- 75 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 2-73(e) OF THE SAN <br />MARCOS CODE OF ORDINANCES TO PROHIBIT MEMBERS OF <br />THE PLANNING AND ZONING COMMISSION AND THE ZONING <br />BOARD OF ADJUSTMENTS FROM REPRESENTING PRIVATE <br />INTERESTS BEFORE THE CITY COUNCIL IN CERTAIN <br />MATTERS; AND PROVIDING A PENALTY. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That section 2-73(e) of the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />(e) A member of the planning and zoning commission shall not <br />knowingly represent the member or any other person, group or <br />interest before the zoning board of adjustments or city <br />council on any matter involving land use or development, and <br />a member of the zoning board of adjustments shall not <br />knowingly represent the member or any other person, group or <br />interest before the planning and zoning commission or city <br />council on any matter involving land use or development. <br />These restrictions do not apply to members representing their <br />interests in their owner-occupied homesteads. <br /> <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion ,had not been adopted. <br /> <br />SECTION 3. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 4. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in section 1-5 <br />of the San Marcos Code of Ordinances. <br /> <br />SECTION 5.
