~.".., ..::r- ~, --w H Ç:- ¡;;...~ 0-""" ç- ¡::::a 128 g u.J~ ill ::-. ... r a::: . ~ ,~ ö!:3 -1~ ('.J.. ~<fX., ORDINANCE 1994 - 78 _,-'1 a..... ~ V./'lf l.1.J ¡::: ~ 0 ':t c,? ~ë5i AN ORDINA.T\TCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING EXHIBITS A AND B TO SECTIONS 30-27 AND 30-35, RESPECTIVELY, OF THE SAN MARCOS CODE OF ORDINANCES TO INCREASE WATER AND SEWER RATES AND TO INSTITUTE A SCALED MINIMUM BILL BASED UPON METER SIZE AND AN INVERTED RATE STRUCTURE IN THE CITY'S WATER AND SEWER RATE SCHEDULES; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Exhibit A to Section 30-27 of the San Marcos Code of Ordinances, is amended to read as shown on the Exhibit A which is attached and made a part of this ordinance for all purposes. SECTION 2. That Exhibit B to Section 30-35 of the San Marcos Code of Ordinances is amended to read as shown on the Exhibit B which is attached to and made a part of this ordinance for all purposes. , SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. That all ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. SECTION 5. That this Ordinance shall be in effect for all billings mailed on and after October 1, 1994. SECTION 6. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect and be in full force and effect from and after its adoption and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Marcos.
